PIOCHE VILLAGE APARTMENTS SHORT-TERM RENTALS 

Rules and Regulations

The following Rules and Regulations, together with such additional rules and regulations as hereafter may be adopted by Pioche Village LLC (“Owner”), shall govern the use of all Units (each a “Unit”) located in the Pioche Village Apartments (the “Pioche Community”) as short-term rentals, and the conduct of all Rental Parties whether the same are approved Guests pursuant to a rental agreement (the “Rental Agreement”) or members of Guest’s party or visitors.

1. Residential Purposes Only

Each Unit in the Pioche Community shall be used only for residential purposes solely by the persons listed as the “Guests” and “Guest’s Rental Party” in the Rental Agreement. Any additional occupant requires the prior written consent of the Manager. Without limiting the foregoing, if the Unit is a studio or is a one (1) bedroom, then not more than two (2) persons shall ever occupy in the Unit; and if the Unit has two (2) bedrooms, then not more than four (4) persons shall ever occupy the Unit, and if the Unit has three (3) bedrooms, then not more than six (6) persons shall ever occupy in the Unit.

2. Nuisance and Noise

Guests shall not permit or suffer any unreasonable noise, disturbance or nuisance whatsoever in the Pioche Community which will obstruct or interfere with the rights of other guests or other residents in the vicinity; nor shall any member of the Rental Party commit or permit any nuisance, immoral or illegal act in or about the Pioche Community. Noise emanating from the Unit shall not be able to be heard by neighboring Units or from the parking lots to neighboring properties. Each member of a Rental Property shall exercise extreme care to regulate the use and occupancy of their Units and to minimize noises and in the use of musical instruments, radios, television sets, amplifiers or other loudspeaker devices in the Units so as not to disturb the other persons occupying Units within the Pioche Community. None of these devices shall be operated between the hours of 9:00 p.m. and the following 9:00 a.m. if the same shall disturb or annoy other occupants of the Pioche Community or adjacent properties. Quiet hours are established as 9:00 p.m. to 9:00 a.m. Social gatherings must be restricted to the Unit itself and cannot be held in parking lots, spa, fitness room(s), or other common areas. There shall be no soliciting anywhere in the Pioche Community by any member of a Rental Party for any reason, cause, charity or purpose whatsoever.

3. Manager

The management of the Pioche Community is under the direct supervision of the Manager contracted with for the purpose of managing the Pioche Community by Owner. The Manager currently has regularly scheduled office hours on-site from approximately 9:00 a.m. to 5:00 p.m. with an additional 24-hour local emergency contact (may be off-site). The Manager shall have the right to enforce these Rules and Regulations. No member of Rental Party shall direct, supervise or in any manner attempt to assert control or authority over any employee of the Manager. The Manager and its designated representatives shall have access to all Units for maintenance, repairs and replacement of the common elements of the Pioche Community or the Unit, as necessary, and to otherwise prevent any damage to the common elements of the Pioche Community or other Units.

4. No Parties

This is not a party property. The primary Guest must be 25 years of age to rent the Unit. Any special occasions such as weddings, receptions, family reunions or an increase of occupants (guests not registered on registration form) must be disclosed at the time the reservation and/or Rental Agreement is made and are subject to the Manager’s advanced approval. For example, prom parties, fraternity or sorority parties, après ski gatherings, or graduation parties, etc. are not allowed at any time. Adults cannot rent property on behalf of underage guests, no exception. A “party” shall include exceeding more than two additional guests than are permitted under the Rental Agreement. Guests shall be responsible for the acts and conduct of all members of their Rental Party. Guests shall advise their Rental Party of these Rules and Regulations, and shall require them to comply herewith.

5. Parking

One (1) passenger vehicle automobile parking space within the Pioche Community has been assigned to the Guest. Guest may park a single passenger vehicle in the assigned area. A hang tag is required to be displayed while onsite and will be provided at check-in. No unregistered guest parking is permitted onsite. No more than 2 temporary guest/drop off parking stalls shall be provided on site. No parking is permitted on county or private roads or rights-of-ways. Vehicles violating this policy will be towed at the vehicle owner’s expense. There is no parking on landscape areas (natural or manmade), common areas, in front of dumpsters, on sidewalks, or off to the side of the driveway or parking lot. Double parking is not permitted. Care should be taken so that the Guest’s vehicle is parked so as not to encroach on the adjoining parking space of another resident. Guests shall park their vehicles only in designated temporary guest parking spaces for periods not to exceed 15 minutes. No boat trailers, or other trailers, trucks, vans, campers, recreation vehicles, and/or mobile homes and commercial vehicles, may be parked in the Pioche Community. Vehicles necessary to the maintenance and management of the Pioche Community by Owner or the Manager (and their contractors) are exempted from the provisions contained herein. Illegally parked cars will be towed away at the Tenant’s risk and expense.

6. No Access to Deer Crest and Adjoining Property

There is no access from the Pioche Community to Deer Crest, Park City via Deer Hollow Road, Velvare, or the Mayflower Mountain Resort. DO NOT ATTEMPT TO GAIN ACCESS VIA THE DEER CREST GATE – ACCESS IS STRICTLY PROHIBITED. ACCESS TO, AND TRESPASSING UPON, ANY OF THE PRIVATE SKI RUNS OR CLEARED AREAS WITHIN OR NEAR THE VICINITY OF THE PIOCHE COMMUNITY IS STRICTLY PROHIBITED.

7. Alterations; Furnishings

No alterations shall be made by members of a Rental Party to any part of the Unit or Pioche Community. Furniture, bedding, kitchen equipment, utensils, and any other personal property supplied with the Unit must not be removed from the Unit. Loss of any items within the Unit or damage to the Unit or furnishings will

be charged to Guest. The Unit will be inspected by the Manager after Guest’s departure. All contents of the Unit are the property of Owner. If an item should break, Guest must notify the Manager immediately. Guest is not permitted to alter the wiring or wifi connections of any television, computer, or gaming equipment.

8. No Animals

No animals whatsoever shall be brought onto the Pioche Community or a Unit unless required by law and with the written consent of the Manager. Any violation of this Rule shall be grounds for immediate termination of the Rental Agreement, at Manager’s option, and in Manager’s sole and absolute discretion.

9. No Smoking

Guest agrees there will be no smoking in the Unit, the building or in the Pioche Community. Any violation of this Rule shall be grounds for immediate termination of the Rental Agreement, at Manager’s option, and in Manager’s sole and absolute discretion.

10. Trash Areas

Trash chutes are provided on each residential floor for disposal of refuse by Guest. The trash chute area must be kept clean at all times. Refuse shall be properly placed in the trash chute or exterior dumpster provided for such purpose, and shall not be left on any of the floors of the Unit, any hallways, or anywhere within the building. In addition, trash must be securely wrapped and/or bagged with the provided plastic bags. No lighted, burning or smoking materials or other lighted objects must not be placed in the trash or trash chute.

11. Equipment and Storage

No skis/snowboards, bicycles, SUPs, other recreation equipment shall be brought into the lobby, common areas, Units or elevators. All recreation equipment must remain within areas designated by the Manager while on site. Ski boots, helmets, and soft goods are excluded from this restriction.

12. No Firearms

Absolutely no firearms of any kind are allowed in the Unit or in the Pioche Village at any time. Guest will immediately lose all rental rights and be subject to immediate eviction with no refunds of any portion of the Full Rental Amount if a firearm is discovered in the Unit or in the possession of any member of Guest’s Rental Party.

13. Insurance Provisions

No member of Guest’s Rental Party shall do or permit anything to be done in the Pioche Community, or bring or keep anything in or on the Pioche Community, that shall in any way increase the rate of fire insurance, or bring or keep anything in or on the Pioche Community that will interfere with the rights of other guests, or in any way injure or annoy them, or conflict with the laws relating to fires, or with the regulations of the fire department, or with any insurance policy on the building or any part of the building, or the rules and ordinances of the board of health.

14. Compliance With Laws

Guest shall comply with all laws, orders and regulations of federal, state, county, municipal and other governmental authorities, and with directors of any public officer pursuant to law, which shall impose any violation, order or duty upon the Guest with respect to the Pioche Community or the use or occupancy of the Unit.

15. Paragraph Titles

The paragraph titles are insured only as a matter of convenience and for reference, and in no way define, limit or describe the scope or content of these Rules and Regulations nor in any way affect same.

16. Compliance with Rules and Regulations

Each member of Guest’s Rental Party shall comply with and abide by all the above Rules and Regulations and also those rules and regulations as may hereafter be adopted from time to time by the Manager. Notwithstanding any of the above Rules and Regulations, the Manager has the authority, under special circumstances, and in its sole discretion, to grant exceptions to these Rules and Regulations. Additionally, the Manager reserves the right to change or revoke the existing rules and make such additional rules and regulations from time to time, as in its discretion shall be deemed necessary or desirable for the safety and protection of the buildings or their occupants.
